Business licences in England: labelling jurisdiction in research notes

A guide to labelling jurisdiction in England business licence research notes, covering licence families, named issuers, fee sources and what to check next.

What to take away

  • The nation decides which rule applies, so label each note with England, England and Wales, Great Britain or UK.
  • The Licensing Act 2003 governs alcohol, regulated entertainment and late-night refreshment in England and Wales only.
  • Issuers are namedthe council as licensing authority, its environmental health team, the Environment Agency and Ofsted.
  • The band A alcohol premises licence application fee is £100; other fees, forms and timescales come from the issuing authority.

Start with the nation, not the licence name

A page headed UK can cover England only, England and Wales, Great Britain, or all four nations. The GOV.UK Find a licence service filters by nation and warns that its catalogue may not include every licence.

Use it to shortlist possible routes, then confirm each route with the authority that issues it. Our survey of licensing research methods helps when several candidate routes have to be compared before you commit.

The main licence families and their issuers

Six families cover most England licensing questions, each with a named issuer and a distinct route.

Premises licenceAlcohol sales, late-night refreshment, regulated entertainmentCouncil licensing authorityCouncil licensing pages and premises licence form

The council acts as licensing authority for alcohol, regulated entertainment and late-night refreshment under the Licensing Act 2003. A personal licence for the designated premises supervisor is a separate application and needs an accredited qualification plus a basic DBS check.

Food businesses register instead of applying for approval. GOV.UK's food business registration guidance covers home kitchens and multiple premises, and registration is free with a deadline of at least 28 days before trading.

Example: a labelled note for a cafe selling alcohol

Nation: England. Site: 40-cover cafe, non-domestic rateable value under £4,300. Activity: alcohol sales for consumption on the premises. Applicant role: sole trader, designated premises supervisor. Source: GOV.UK Find a licence and the council licensing pages, accessed [date]. Fee checked: band A premises licence application, £100. Open question: does late-night refreshment apply past 23:00, and is planning consent needed?

Jurisdiction label before opening a form

  • Record the site
  • Record the activity
  • Record the applicant role
  • Record the nation
  • Use Find a licence filters
  • Separate rows for each nation

The nation label stops anyone reusing the note for a Scottish site. The open question shows what remains unchecked, and our comparison of official licensing tools shows which source to open next.

Research steps that keep the note accurate

  1. Fix the nation and the site before opening any form.
  2. Describe the activity in ordinary words, such as 'sell alcohol after 23:00'.
  3. Match the activity to a licence family and its issuer using the table above.
  4. Copy the exact form name, fee band and evidence list from the issuer's page.
  5. Save the source, access date, geography and any unanswered question.

When GOV.UK and a council page disagree, compare jurisdiction, audience and update date. Then put the question to the issuing authority and keep the written reply.

Where fees, timescales and forms come from

This article does not list every fee, form or processing time, because the council or regulator sets and revises them. The national fee regulations band alcohol premises licences by non-domestic rateable value; band A, for premises up to £4,300, is £100.

GOV.UK's premises licence guidance covers who applies and how the process runs. Your council publishes the current amount, its own form and its evidence checklist, and that local page is the version to trust.

Budget for more than the fee. An accredited personal licence qualification, scaled plans and the statutory advertising of the notice all consume time or money. Our licensing budget template records official sources, preparation and payment timing together.

Planning permission and environmental permits sit outside licensing

A premises licence does not grant planning permission and does not authorise a use the planning system prohibits. Change of use or a new extractor flue may need consent from the local planning authority. Some industrial processes need an environmental permit from the Environment Agency or the council. Check both regimes alongside the licence.

Common questions

Do England and Wales licensing rules apply in Scotland?

No. The Licensing Act 2003 covers England and Wales, so a Scottish premises licence comes from a licensing board under separate legislation. Check the nation before reusing a note.

Can I hold a premises licence without planning permission?

The two applications are separate and can run in parallel. A council may ask about planning status, and a licence does not authorise a use planning permission forbids.

Does a home kitchen need food business registration?

Yes, if you prepare or sell food regularly, including from home. Registration with the council environmental health team is free and must be made at least 28 days before trading.

What if GOV.UK and my council page disagree?

Compare the jurisdiction and update date on both. Ask the issuing authority in writing and keep the reply with the note.
